It's certainly not a silly question. As I understand it, the decision was largely based on legal and political considerations. It is imperative that the devs are protected from attack....I think we can all agree on that. I'm not sure what the political influences were. As it happens, despite the frustrating compromises, they seem to be accomplishing the most important goals and that is a very broad awareness and distribution.
