The problem with self-regulation is the big whales can dictate whatever they want. But as in the real world, if enough people can gather to voice their will, this can empower them to set their own rules too. What we have right now is a system with mathematical rules running 24/7, but faulty as it is, human nature is what's causing all the troubles.
