TL;DR- PETA sued a photographer for copyright of photos made with a camera set up for motion activation. A lower court ruled in the photographer's favor. PETA appealed to higher court, but settled before a ruling.
More- PETA was probably going to lose in the higher court, but they have the money to push the case up through the Supreme Court, who knows. At the least, they'd keep the photographer in court, losing money and business until he caved. ...So he caved early. I'm sure that at least the Institute for Justice would be willing to help.
If PETA were to win, it would set a very dangerous precedent. It would set the precedent that the subject owns copyright to images of themselves; and can thus require the removal and destruction of its image from any media. No more citizen journalists. No more "caught in the act" bad publicity for the rich and famous. PETA is idiotic.
