On November 8, 2016 Proposition 64 “Adult Use of Marijuana Act” passed in the State of California. The following day, personal use was legalized. Dispensaries are open for business as of Jan 2018 in California.

I'm not going to list all the “DO’s” but instead will focus on a few of the “DO NOT” facts!

Educate yourselves and read up on California Health & Safety code 11362.1(a) for what you are allowed to do in California.

Also, Health & Safety code 11362.2 sets out the requirements for marijuana plants that you plan on growing. This code applies to persons over 21.

Health & Safety code 11362.3 outlines what you may NOT do in California based on the passing of Prop 64.

The following are prohibited and are infractions:
You can't smoke marijuana in a public place unless authorized by local ordinance.

Marijuana may not be smoked in a location where tobacco is also prohibited.

You may not smoke marijuana within 1000 feet of a school, daycare center, or youth center while children are present. Your private residence is exempt if smoking is not detectable by others on the grounds of the school, daycare, or youth center.

You are prohibited from possessing an open container or package of marijuana or marijuana product while driving, operating, or riding in the passenger seat or compartment of a motor vehicle.

Possessing, smoking or ingesting marijuana upon the grounds of a school, daycare, or youth center while children are present is prohibited.

Using volatile solvent to manufacture concentrated cannabis is prohibited.

Smoking or ingesting marijuana or marijuana products while driving is the same as a DUI alcohol 23152(a) CVC.

Passengers of a vehicle are prohibited from smoking or ingesting marijuana or marijuana products.

The law enforcement community is still trying to digest the marijuana laws (no pun intended) and are creating policies to deal with enforcement.

I am interested to see stats in the year(s) to follow to see if there is a significant increase in DUI drug arrests!!!

Great advice. I would also add that if you would like to grow your own, check the local city municipal code. For example, my city requires you to grow only indoors and with certain restrictions. We do not require a permit, but some cities do. Any violations are misdemeanors that will result in pretty hefty fines, so be careful and mindful.
