Justice Out Of Reach For The Poor

We are in the land of the free, everyone living his piece, under a common law, a common law that serves everyone equally, where no one is above the law, where everyone is given an equal opportunity and rights of due process. We are in a land of freedom, where fairness is administered generously across all, and justice is a rod of truth and righteousness within the confinement of our society. 

These are the words that are used to describe the Justice system. We live under a Justice system pure and filled with many charming maxims. Please spare me the sugar talks, All that motto of equality and fairness only give a false hope, its a mirage. The justice system I see right now has become an irony, Justice is now for sale in the market of the law, Justice is a commodity measured in Gold. Mete in the confinement and boundary of wealth.

Do we still speak of Justice?, my ink does not flow because it wants to but because it needs to, for the evil of the Justice system wears a Louis Vuitton, disguising its horrors. The populace  have been made to believe in the Justice system so much that all the evil and corruption bubbling within it is overlooked. I hate to admit it but I would, the spurs of inequality has been evident for long now in our Justice system dating back to our father's fathers. Just as inequality defines our society, so also inequality defines our Justice system and every form of court system, but the family court system is forever most wanting to this "crime" of inequality and the absence of fairness is most heavy.

Here we are today, in a mess we wish to escape from, a system where "The rule of Law" no longer covers the poor. Since Justice have been so inclined to the meters of Wealth, a parent without the Gold Bar has no place, has no voice, has no equal right. Infact, in light of what we see in the society right now, The rule of Law and due process of law is left for those with the most money, to the rich. Impoverished homes loses their children to CPS because Due Process of law belongs to the Rich and the poor are made silent. How can we fight for our children when the family court system and its setup makes it almost impossible 

They say, every one has a right to Counsel, of course, parents are provided the Most Sound Court Appointed Attorneys to help "poor" parents fight for their children, ironically. These attorneys become the destructive atomic bomb that ends up leveling homes they are supposed to protect. Offering your child on a platter of gold to CPS. We know the usual drill, and I believe there are some good court appointed attorneys out there ready to help, but are dwarfed in a seemingly high percentage. This good ones are like a grain of rice in a mountain of gravels.

CPS is confident to take parents to court and it will be an easy win because our Justice system is sold to the rich, and victimizes the poor, the weak, and the low. It is Partial, filled with criminal acts and the eyes that solely perceives the dollar. 

Welcome to the Gold Age, not golden, where 

  1. The rich who seriously abuses his child is left to keep them and is still a Fit Parent, but the poor who "allegedly" neglects a child is judged Unfit to keep their child.
  2. A rich convicted criminal, rapist, pedophile, sex trafficker, you name it is given probation or is discharged but still fit to keep their children. The poor with a domestic is unfit and his parental rights may be terminated. 
  3. You don't have the voice or Right* to fair judgement if you are closer to the the impoverished class. 

 The list goes on and on, CPS and the juvenile dependency court system is not made for the Rich but for the poor and the weak. Families that can not wage the storm of CPS are always at the slope, on the steep edge of been picked off. CPS is a tool to intimidate and prey on families on the bottom edge of the societal class, not for the High Class. This truth is staring at us all in the face and seen deep within the structure of the System. The Odds Are Never in Our Favor. Inequality runs the CPS and court system, and only those with gold to trade can navigate these colored waters.

such a genuine and wonderfull article...!!!
At time of start of civilization when human was struggling for shelter food etc they were fighting for survival equally
But today unfortunately we can see how poor and rich people are devided among states and among nation..!!
We need sustainable and equiatable growth model

Not to sound like a jerk, but we are expected to know the law. We are expected to present our facts to a judge.

I do agree with 99% of what you wrote though along the premise that our justice system is broken.

My disagreement starts here

By stating this, do you really believe it? Ive seen poor people in a judicial setting upset CPS. How? Because they learned about how it worked, they never gave up citing inequality. I'm not going to cite all precedents that demonstrate being poor is not neglect.

Where my child to be taken today. Better believe this means war. Help me help others educate on how CPS works. Knowledgable families is a force that CPS/State is afraid of.

All true. Except that the rich don't need to spend the hours upon hours of research to understand their rights and how to fight back. They can just pay the best lawyer for that. Actually, their children will probably not be approached by CPS in the first place, because CPS knows that they will have to fight the best lawyers and that they will have a harder time trying to prove that the children are neglected when they live in a nice home.

It takes a lot of fortitude and intelligence to fight this system with no money. And that's if the person has even had the chance to gain access to the information needed.

Liberty and Freedom has never been claimed to be free. If ignorance paid as much as knowledge there would be no benefit to becoming knowledgeable.

If it took no fortitude or intelligence than knowing the law would have also no value. The fact that your are correct that it takes fortitude and intelligence is actually a good thing to know. This is because what is needed is identified. More Fortitude and intelligence are needed.

Seems like a nice description of what many of us are trying to do for our fellow human beings? Thus anyone who takes up the challenge of having more knowledge and fortitude deserves respect and will get my encouragement. From experience currency is usually a problem that becoming knowledgeable solves. One of the reasons I donate to #familyprotection is the programs being supported with actually currency to help those who need it to get to the point where that knowledge becomes the solution to poverty.

Bringing more knowledge and fortitude into the world. I like being a part of that!

ihashblox, I get the perspective you are coming from, you are right about it since you are basing it on parents being knowledgeable.
On paper this is true, and I have witnessed a little percentage doing so, but there is a huge margin between the justice system for the rich and poor on an equal floor.
If you ave attended a CPS hearing or have been unfortunately opportune to be a victim, you will see clearly that your words and knowledge seem to be effectively almost zeroed out.
I stand by what this post says and most times, the rich families don't get visited.

I think CPS should be done away with in general. However, I do agree. It is predatory.

Not because your facts are wrong, but in that you are stating it is because they are "poor".

You are wrong. Very wrong.
This is a systemic problem.
This is not rich vs poor.
This is the system vs. everyone.

There are those who own the system.
They get away with child trafficking, rape and murder.
They need children.

There are those who are considered easy prey.
They go after the poor, not because they are poor, but because most of them are hella stupid. They do not know what their rights are. They don't know anything about the legal system or the law.

If the poor wanted to do something about this system, it would be easy. Just show up to court for everything. Make a judge hear your case for every ticket. Never take a plea deal. The entire system would grind to a halt.

It is the system. We are told that the system is for justice, that everyone gets their day in court. But it isn't true. The system is designed to take so many children away from their parents per month.

Even the so called 1% (dual income professional families) can't afford lawyers to fight the system.

So, don't start by saying its about the poor.

I don't like your attitude in this comment. You are telling her that the poor are stupid! Wow! I wrote a series of posts about my friend Anna and her fight against CPS, and she is HIGHLY INTELLIGENT! Yet she had a long, terrible fight.

From what I can tell about the person sharing this post, they went through their own terrible court process with CPS. So they are talking from experience and how being poor made them more vulnerable to attack and hindered them in their fight to keep their family together.

Also, you say that it is easy to win -- that you just have to show up and fight everything. But what happens when showing up to the constant court dates and meeting all the CPS demands upon you mean that you can not go to work? Not going to work means that you don't earn enough money to eat and pay for your rent. Not paying for your rent makes you homeless which then gives CPS even more ammunition to not give your children back. Many, many families have been financially devastated from fighting CPS. In fact my friend Anna's family, which was already poor, were put into TONS of debt through the process. The debt was not because of lawyers (which were paid for by Legal Aid) but because of things like them forcing her husband to move out and have to pay for a second home, while still trying to support his family.

Though you seem to say I am wrong, of course you are entitled to your own opinion. But I can't help but notice that you are driving towards agreeing with all I have said, except for the fact that you think "Showing up and never taking a plea" automatically brings your child home.
It is so much more than that builderofcastles.
The system is rigged and the poor are paying for the system's criminal nature.

I do agree. CPS is an evil enterprise for supplying fresh children for nefarious activities.

When you start off with being about the "poor", you make this a class war. When it is not about class.

CPS is evil, by design. There is no justice in that system.

But, you will not see that until all the poor kids are gone, and then CPS starts working on the middle class kids.

And, if you really looked at who is getting hit with CPS it is people from all walks of life.
The only difference is those who know better never let CPS passed their doorway, and that makes a huge difference.

So, i am trying to state that your "source of the problem" is misplaced. And thus, all your efforts will be for not.

So you're stating waive your right to due process? CPS or family courts are not like traffic courts. It's very obvious you're not educated on how the legal system operates.

How is showing up to court waiving your right to due process?

Further, delaying tactics are an excellent method of handling bureaucracies. There are lawyers who are paid to keep things out of court by enacting legal delays.

My statement is for the people to overload the system so that it cannot function. And overloading the system in one area, pulls resources from another. All judges have to do some traffic court duty.

Paper terrorism. Wow. Ok just shut up. How many cases are won by paper terrorism? Tell me.

If you cant tell me why appearing in a family court case and trying to presenting facts is a violation of due process, maybe you shouldn't be sharing your opinions.

I do not care about tactics BAR attorneys use, they are apart of the problem.

Over in Mississippi they tried to enact red light cameras.
No one paid the fines. No one.
The red light cameras were removed.

What i think you are calling "paper terrorism" is how court cases are won.
If you are in a battle with CPS, you never turn over your children. And you make CPS and the court jump through every hoop.

Further, if you drag out your court case with CPS, you tie up court time and bureaucrat time that can't be used to harass someone else.


Due process has nothing to do with facts.

If you are in a court battle, then you follow the rules of the court.
Thus, you HAVE TO follow the tactics of BAR attorneys.
And why would you follow those tactics? Because they work.

I hate the BAR and i hate the court system.
There is no justice there. There aren't even any american courts.
The whole structure should be abolished.
However, if you find yourself having to go to that wretched place, you better know the rules of the game. Not knowing, or not using those rules means you have already lost.

What jurisdictional subject matter is granted to family courts? When did a title Iv agency single and seperate under executive branch become a judicial venue? Never. Listen .. it's just wrong. There are things called fraud, harrassment, duress, etc etc. But do not do paper terrorism.

Furthermore, breathing in a family court is pointless. Goto one sometime, watch how they trample people. Its pointless.
