Initiative - Week 3 - Is Justice blind? // La Justicia es ciega?

Justice, a somewhat subjective word, because it depends on the ethics of each person and for each person justice has a different meaning.

Of course, in a general sense it is to act with objectivity, truth and equality granting what each one deserves; but who is the judge that determines what each one deserves?

Let's think about judges and laws, they, the judges apply the sentences based on the laws, but, and if the laws are flawed or have loopholes, wouldn't an innocent person be wrongly prosecuted?

By this I do not mean that I do not agree with justice, especially when we live in a society where there is as much diversity as there are people; and the intention is to protect our rights as citizens.

But let's go back to judges and laws. Those who write the laws in many cases, are the same ones who apply them, it is as if they charge me and give me the turns, so the question is who chooses what is fair for society? Or will it be that they choose what is fair for those who write the laws.

I can only think that we are the playthings of a group of men playing gods, imposing laws, and dictating what is just or unjust ... but if for me what they call justice is something totally unjust, wouldn't my freedom, my right to express myself and my right to be different be curtailed?

Then justice is blind, yes, as we see it represented in the statue of the goddess Themis, whose name means "law of nature". A blindfolded woman, a scale in one hand and a sword in the other. Ah, but let me tell you that Themis represents divine justice, that which is not applied by humans playing gods.

While human justice is represented by Nemesis, another goddess who also carries a sword, but she, "...is the goddess of retributive justice, solidarity, revenge, balance and fortune. She punished those who did not obey those persons entitled to command them..." Taken from Wikipedia

Reading about Nemesis, I understand that his justice is more like the one we apply as humans; what happens is that the law scholars, trying to soften their judgments, placed in Nemesis' place Themis as a figure representing human Justice.

Of course, which human judge wants his sentences to be associated with the goddess of vengeance and who punishes those who do not obey those people entitled to mandalas?

Notice that as human beings we want to play gods. Those privileged to handle the laws, believe they have the right to command us and of course as we live in a society, whether we want to or not, we have to be right.

AHORA EN ESPAÑOL

Justicia, una palabra un tanto subjetiva, pues depende de la ética de cada persona y para cada persona la justicia tiene un significado diferente.

Claro, en un sentido general es actuar con objetividad, verdad e igualdad otorgando lo que cada uno merece; pero y ¿quién es el juez que determina lo que cada uno se merece?

Pensemos en los jueces y las leyes, ellos, los jueces aplican las sentencias en base a las leyes, pero, y si las leyes están viciadas o tienen vacíos, ¿no se enjuiciaría erróneamente a un inocente?

Con esto no quiero decir que no esté de acuerdo con la justicia, sobre todo cuando vivimos en una sociedad donde hay tanta diversidad como personas; y la intención es proteger nuestros derechos como ciudadanos.

Pero volvamos a los jueces y las leyes. Quienes redactan las leyes en muchos casos, son los mismos que las aplican, es como si me cobrara y me diera los vueltos, así que la pregunta es ¿Quién elige lo que es justo para la sociedad? O será que eligen lo que es justo para los que escriben las leyes.

No puedo más que pensar que somos los juguetes de un grupo de hombres jugando a ser dioses, imponiendo leyes, y dictaminando qué es justo o injusto … pero si para mí lo que ellos llaman justicia es algo totalmente injusto, ¿no se estaría coartando mi libertad, mi derecho de expresarme y mi derecho a ser diferente?

Entonces la justicia es ciega, si, tal como la vemos representada en la estatua de la diosa Temis, cuyo nombre significa “ley de la naturaleza”. Una mujer con los ojos vendados, una balanza en una mano y una espada en la otra. Ah, pero déjame decirte que Temis representa la justicia divina, esa que no es aplicada por los humanos jugando a ser dioses.

Mientras que la justicia humana está representada por Némesis, otra diosa que también porta una espada, pero ella, “…es la diosa de la justicia retributiva, la solidaridad, la venganza, el equilibrio y la fortuna. Castigaba a los que no obedecían a aquellas personas con derecho a mandarlas…” Tomado de Wikipedia

Al leer sobre Némesis, entiendo que su justicia se parece más a la que aplicamos como humanos; lo que sucede es que los eruditos en leyes, tratando de suavizar sus juicios, colocaron en lugar de Némesis a Temis como figura que representa la Justicia humana.

Por supuesto, ¿cuál juez humano quiere que sus sentencias queden asociadas a la diosa de la venganza y que castiga a los que no obedecen a aquellas personas con derecho a mándalas?

Fíjate que como seres humanos queremos jugar a ser dioses. Los privilegiados de manejar las leyes, creen tener derecho a mandarnos y por supuesto como vivimos en una sociedad, queramos o no, nos toca estar a derecho.
