Brazil vs. X: the fight continues

The powerful Supreme Court Judge Alexandre de Moraes ordered the blocking of Starlink's financial accounts in the South American giant, as a pressure measure against Elon Musk to define who are the representatives of X in Brasilia, under penalty of it facing the “immediate suspension of [its] activities [there]”. The company is being investigated by de Moraes for allegedly having served as a vehicle to spread disinformation about the elections and also to coordinate coup actions. In this regard, the judge has demanded the suspension of certain profiles associated with the actions he denounces, to which Musk has refused in a rebellious manner. The tycoon said that de Moraes “is a real criminal of the worst kind, who pretends to be a judge”. Starlink defended that “[the court] order is based on the unfounded premise that [it] should be responsible [for payment] of fines imposed, unconstitutionally, on X”.

Soon, we expect Judge Alexandre de Moraes will order X to be shut down in Brazil – simply because we would not comply with his illegal orders to censor his political opponents. These enemies include a duly elected Senator and a 16-year-old girl, among others.

U.S. resumes immigration program targeting certain countries in region

The U.S. government is resuming a program that grants humanitarian parole to immigrants from Haiti, Venezuela, Nicaragua and Cuba who have financial sponsors, adding controls to prevent fraud by the latter. The Department of Homeland Security suspended this legal avenue of entry in early August, but now suggests there is no cause for alarm because cases of fraud are not statistically representative. “In addition to the rigorous vetting of prospective beneficiaries seeking to travel to the United States that already takes place, new procedures for sponsors have strengthened the integrity of these processes and will help prevent exploitation of beneficiaries”, it said. Among the indications of fraud that have been disclosed are that just over 3,200 individuals served as sponsors for more than 100,000 applicants, and that 24 of the 1,000 most frequently used Social Security numbers were for deceased individuals.

Through this program, the United States accepts up to 30,000 individuals per month from the four countries mentioned above, who can live “the American dream” for two years with the possibility of applying for a work permit (in the case of Cubans, specific legislation from 1966 allows them to regularize their immigration status on a permanent basis). As of July 2024 some 205,000 Haitians, 115,000 Venezuelans, 109,000 Cubans, and 90,000 Nicaraguans arrived lawfully and were granted parole thanks to this initiative. Although with limitations, there is no doubt that the Biden administration has broadened the channels to reduce the pressure produced by irregular migration, which at the same time is faced with greater severity at the border with Mexico. Measures instituted in June, along with a more aggressive stance by Aztec authorities to discourage illegal crossings, have reduced the latter by 55%.

The program has been strongly criticized by Republican governors and lawmakers, who argue that the White House is abusing its legal prerogatives in immigration matters. "Instead of scrapping the clearly flawed program, the [DHS] is allowing it to continue without rooting out the fraud or putting adequate safeguards in place to prevent exploitation by sponsors here in the United States. But fundamentally, there would be no fraud to prevent if DHS simply stopped importing 30,000 inadmissible aliens every month in the first place", said Republican Representative Mark Green, chairman of the House Homeland Security Committee. The use of the CBP One™ Mobile Application—which as of this month is available in certain areas of southern Mexico—is also the subject of fierce criticism from the Republican caucus.
