A homeschooling family from Kaufman, Texas, claims that CPS illegally took their son away. The family says that CPS never contacted them or their lawyer to tell them what they did wrong. To CPS it was allegedly an emergency removal and it coincidentally came after the family had made a complaint about the hospital, alleging that they mistreated their son. The hospital told them that they would review the case and respond within roughly 45 days, that's about when CPS showed up at their door.
"We have an attorney that has asked many questions, and he has not gotten any answers. We're willing to work and cooperate, but we are not getting anything. It's been two weeks," - Drakes' dad, Mr. Pardo
Their son Drake suffers from multiple health issues and a social media campaign has been started to try and raise awareness for the case, under the tag #BringDrakeHome.
A judge who was recently presiding over their case had issued a gag order to all those involved in the case. A judge has upheld that decision to remove the child over allegations of possible medical abuse.
Court documents also reveal that they believe his mother, Ashley Pardo, might be suffering from Munchausen syndrome by proxy, and embellishing physical or mental illness for her son when there isn't any.
For now, CPS will remain the sole temporary custodian for Drake. Both of his parents have also been ordered by the court to undergo psychiatric evaluations and to attend counseling, as well as fully cooperate with CPS officials.
It isn't clear when the next hearing on this case might be, but the family attorney insists that CPS failed to meet a variety of legal requirements in order to satisfy an emergency removal under Texas law.
