A number of factions assessed the formation of the Special Committee for Foreign Worker Questionnaire (Pansus TKA) initiated by Gerindra Faction and PKS Fraction is not needed.
The unsupportive faction reasoned that the government had clarified the Presidential Regulation No. 20/2018 on the Usage of Foreign Workers (Perpres TKA) completely in a working meeting at Commission IX of the House of Representatives.
The proposed formation of the Special Committee for Foreign Workers who was rolling in the House of Representatives was aimed at criticizing the issuance of Presidential Regulation of Foreign Workers (TKA). Some factions considered the government's explanation to be sufficient. For example, the Golkar faction and PDIP.
"In view of the Golkar faction, we do not see the easing (TKA) .Indeed, we need to strengthen the structure, the infrastructure to accelerate the processing time of foreign workers," said Vice Chairman of IX Commission Ikhsan Firdaus in a discussion entitled "Strong Adjunct Task Force of TKA Questionnaire" Jakarta, Thursday (3/5/2018).
Golkar Party politician explained, many positive things in the Perpres of foreign workers. Among the strengthened online systems, the handling of permits of foreign workers who have been through many doors has become simpler, including the ministry's technical recommendations.
"Take for example the use of foreign workers in the Ministry of Energy and Mineral Resources which has been in need of recommendation, EMR gives one door of TKA with quite strict requirements," he explained.
Ikhsan acknowledged, indeed there are weaknesses in the process of supervision of foreign workers. Alien Regulatory Team (Timpora) in the Directorate General (DG) Immigration Ministry of Justice and Human Rights (Kemenkumham) can only supervise at the entrance. In addition, the visa free visa policy makes Timpora overwhelmed.
"Therefore we at the Commission IX asked the government to form a Task Force (Task Force) Supervision of Foreigners This is what we need to strengthen," he said.
According to him, this TKA Regulation of the month means loosening the entry of foreign workers to Indonesia and making the number of illegal foreign workers and unfamiliar laborers coming in various regions. Ikhsan affirmed that the formation of TKA Special Committee is not required in DPR.
Earlier Treasurer PDIP Faction Alex Indra Lukman stated that the TKA Special Committee has not been necessary. Commission IX has proposed the establishment of a taskforce to investigate foreign workers.
"We are monitoring the results of the meeting at Commission IX," he said. "All the suspicions have been answered by Minister of Manpower and enough explanation about the Perpres of Foreign Workers, so we do not need to set up a special questionnaire."
Meanwhile, Vice Chairman of the House of Politics and Security Coordinator (Famli) Fadli Zon said the issue of privileging foreign workers through Presidential Regulation 20/2018 became a hot issue in May Day or Labor Day.
Because foreign workers are privileged, while local workers are not. Even local labor subsidies are repealed by the government.
"There are some facts and data I think is a problem in this foreign workforce, which is foreign labor, especially illegal and foreign labor which is a labor force or unskill labor," he said on the same occasion.
According to Fadli, the foreign unskilled laborers should not enter Indonesia. But in fact, many foreign unskilled laborers are found in a number of areas.
From union data of Confederation of Indonesian Trade Unions (KSPI), there are 170,000 unskill workers in the country.
While the government also does not know the data of illegal foreign workers who enter. He explains, in the data from 2016 Kemenkumham known there are 7,787 immigration violations.
In employment matters there are 1,324 labor violations. "We see that the problems of this foreign worker are several things, the first is the visa-free issue in Perpres No. 21/2016," he said.
According to Fadli Zon, the number of foreign workers in the country is illegal due to visa-free policy. Another factor is the existence of a tenking project in which foreign investors bring unskilled laborers from their country to the country.
Ombudsman RI (ORI) has also released its findings on foreign workers. "So I wonder if anyone says that this perpres gives to what its name, it is harder for foreign laborers to come in. What is there is loosening into Indonesia and taking quota, that is the problem," said the Gerindra politician.
He explains, at least there are three regulations that loosen the terms of use of foreign workers. First, the Regulation of the Minister of Manpower and Transmigration (Permenakertrans) No. 16/2015 which eliminates the obligations of foreign workers have the ability to speak Indonesian.
Indeed, in the perpres there are provisions of the company shall facilitate foreign workers related to language skills. "Mandatory to facilitate with the obligation to have the ability to speak Indonesian two different things," he added.
Secondly, at Permenakertrans Number 35/2015, the obligation to recruit 10 local manpower each 1 TKA is abolished. The Presidential Regulation Number 20/2018 includes permission to use TKA which the process is accelerated to two days.
