A. Background Issues
The progress of the Acehnese has occurred in various fields due to the development of science and technology, progress itself brings impact not only positive but also negative ones. Positively progress is among others with the easier human to meet the needs of his life, but it is not impossible progress to add complex human problems, this can be seen from the number of criminality that happened one of them is the conflict that occurred in Aceh.
After a long period of prolonged conflict, it was difficult for the community to make progress but after the signing of the Memorandum of understanding (Mou) on 15 August 2005 between the Government of the Republic of Indonesia and the Free Aceh Movement (Gerakan Aceh Merdeka, GAM), a change was made to the people of Aceh. One form of such changes is the issuance of Law no. 11 of 2006 on Aceh Governance.
Based on Article (1) paragraph 22 of Law no. 11 of 2006 on the Government of Aceh, Aceh is the only province that runs the Shari'ah of Islam. But in the life of the people of Aceh Shari'at Islam can not be implemented perfectly. There are some violations against the Islamic Shari'ah Qanun which are resolved not in accordance with Islamic law for example, for violators against the khalwat qanun and committing adultery. Each of the arrested couples is judged by the community when the act is a criminal act that is strictly prohibited in Islamic law.
This khalwat was previously unknown in the rule of law in Indonesia but after the existence of Qanun no. 14 In 2003, khalwat was known under Indonesian law through this Qanun. After the enactment of the Khalwat qanun many of the perpetrators who had caught this membutikan success of the qanun, this is based on data obtained at the Department of Wilayatul Hisbah and Satpol PP Kota Lhokseumawe. Judge itself is a phenomenon that we often encounter in Aceh society. Especially in the city of Lhokseumawe vigilante action can be found in markets, terminals and in other public places against a perpetrator of khalwat crime, adultery, thieves, or the spread of religious sects that are believed to be heretical, resulting in injuries and even death of the perpetrator . Not a few lost their lives as a result of their own vigilante actions, but the police could not take precautions when the vigilante was conducted by the public, the reason was, if it were not for the lack of members of the police, the large number involved the masses, as well as being late to the scene .
The number of vigilante acts committed against seclusion couples can be seen based on the existing data at the Syar'iah Court of Aceh Province in 2010, that is, there are 68 cases of khalwat and almost half of the cases of vigilante offenses. Vigilante action is done by means of baths in the trenches or paraded from the found place berkhalwat up to places of worship (mushalla or recitation hall). In addition, the act is accompanied by acts of violence against the perpetrators of khalwat criminal acts so that many perpetrators of khalwat suffered injuries or bruises in various limbs. Violent vigilantism in this way often occurs against couples committing the criminal act of khalwat.
Violent vigilante perpetrators committed the act of khalwat, because the community was angry with the couple who committed the act, because the community considered the action could bring misfortune or misfortune against the village. But unknowingly, the community has committed a crime. This action will be detrimental for the people of Aceh itself later if it continues to be done. If we see violence perpetrated against the couple, this act is almost a habit that is perpetrated continuously and may almost become a new custom for the people of Aceh. It is feared that this custom becomes an adat for the people of Aceh, because it is far from Islamic values, humanitarian and contrary to the Laws.
