The international non-profit association is a group of natural or legal persons who pursue a disinterested goal of international utility. This legal form, although similar in various respects, cannot be confused with the asbl (non-profit association). Indeed, the aisbl has its own characteristics: 👇
L’association internationale sans but lucratif est un groupement de personnes physiques ou morales qui poursuit un but désintéressé d’utilité internationale. Cette forme juridique, bien que similaire en divers points, ne peut être confondue avec l'asbl (association sans but lucratif). En effet, l’aisbl a ses propres caractéristiques: 👇
✍️ The international character of the association is determined by the disinterested goal of international utility. The purpose as well as the activities it intends to carry out must be mentioned in the statutes.
The registered office must be located in Belgium.
As soon as a common project is defined, the statutes, which represent the basic principles of the organization, must be drawn up in an authenticated document. The intervention of a notary is therefore necessary. The legal personality will be granted later on by Royal Decree. A new Royal Decree will be necessary for any subsequent modification of the object and/or activities.
✍️ Le caractère international de l’association est déterminé par le but désintéressé d’utilité internationale. Le but ainsi que les activités qu’elle se propose de mettre en œuvre doivent être mentionnés dans les statuts.
Le siège social doit se situer en Belgique.
Dès qu'un projet commun est défini, les statuts qui représentent les principes de base de l’organisation doivent être rédigés par acte authentique. L’intervention d’un notaire est donc nécessaire. La personnalité juridique sera accordée par la suite par arrêté royal. Un nouvel arrêté royal sera nécessaire pour toute modification ultérieure de l'objet et/ou des activités.
👀 As an association, the members of an aisbl cannot receive any material benefit from the aisbl. The law does not require a minimum number of members, but an association requires at least two members. However, in order to avoid paralysis, it is advisable that the association be composed of at least three persons. The status of the members must be regulated in the statutes because the law gives the founders complete freedom.
👀 En tant qu’association, les membres d'une aisbl ne peuvent recevoir aucun avantage matériel de la part de l’aisbl. La loi n’exige pas un nombre minimum de membres, mais une association suppose qu’il y ait au moins deux membres. Toutefois, afin d’éviter la paralysie, il est conseillé que l’association soit composée d’au moins trois personnes. Le statut des membres doit être réglementé dans les statuts car la loi donne aux fondateurs une totale liberté.
