I was thinking more of a situation where one party contracts with the other to supply blue parts for X value from the purchaser, and the funds are deposited into the contract. However, instead of blue, the supplier gives green parts that work just as well but are obviously not blue (and color does not really matter for purposes of the product).
So in essence, my question is, obviously the supplier has supplied the wrong color, but given that they have supplied a product that works just as well (partial compliance), would the buyer still get all funds from the agreement even though the Buyer has useful parts?
I'm not sure if this is the best example, but I hope that clears up my question.
