IMO, making a digital painting could certainly be tracing a photo digitally and coloring it in, if that is what you were planning on doing. That is the beauty of photoshop. People do it all the time.

Take comics for example. Artists have reference files of people in different, common poses for their characters so they can quickly get the shape of the human form for each scene without spending a lot of time on anatomy and perspective.


Not only do they trace over those, but they will go online and find different objects they may need. Once you quickly trace them to get the right shape, the coloring in whatever style you are doing is what's giving it its unique look.

The colors and detail are not the same as the original photo and it certainly takes talent to get the blending/shading to look right even if the photo is traced.
